GianClaudio Finizio Appointed to Meritas U.S. Leadership Committee

Sara Bussiere Selected to Participate in the 2019 Federal Trial Practice Seminar

Wilmington, Delaware – Bayard’s Sara E. Bussiere has been selected as one of eight participants in the 2019 Federal Trial Practice Seminar. The program is sponsored by the United States District Court for the District of Delaware and the Delaware Chapter of the Federal Bar Association. The intensive eight-week instructional program provides lawyers an opportunity to work directly with Judges and experienced practitioners to practice and hone their trial skills.

The program will cover topics including Courtroom Presentation and Demeanor, Opening Statements, Direct Examination, Cross Examination, and Closing Arguments. At the end of the program, the participants will participate in a one-day Mock Trial in front of a jury comprised of Delaware citizens.

Sara E. Bussiere is an associate in Bayard’s Litigation Department. Sara concentrates her practice on corporate and commercial litigation in the Delaware Court of Chancery, Delaware Superior Court, and the United States District Court for the District of Delaware. Sara counsels clients concerning the General Corporation Law of the State of Delaware and Delaware’s alternative entity statutes. Sara has experience in a broad range of corporate matters, including fiduciary duty claims, corporate and alternative entity control disputes, advancement and indemnification claims, trade secret and noncompetition agreement disputes, and other breach of contract claims. Sara also has experience advising corporate entities in receivership or seeking dissolution.

Bayard Recognized at 2019 Combined Campaign for Justice Appreciation Breakfast

Wilmington, Delaware- On March 11, 2019, Bayard P.A. was recognized at the annual Combined Campaign for Justice Appreciation Breakfast. In 2018, one hundred percent of the firm’s attorneys participated by contributing to the annual fundraising drive which originally began 20 years ago. Bayard also donated at the Benefactor level ($5,000-$9,000). The firm is committed to supporting the Combined Campaign for Justice’s mission of increasing the availability of legal services to low-income Delawareans.

Since 1999, the partnership has sought to increase the resources available to allow the legal services providers to represent low-income Delawareans in cases of tremendous import. Peter Ladig to Speak at ABA Spring Meeting

Wilmington, Delaware- On Thursday, March 28, 2019, Peter B. Ladig, co-chair of Bayard’s litigation group is scheduled to speak at the Spring Meeting of the ABA Section of Business Law during the business divorce portion of the Recent Developments in Business & Corporate Litigation: Annual Review Panel program. The program will also feature panelists Justice Timothy Driscoll of the New York Supreme Court and Vanessa Tiradentes, former Bayard associate, now a partner at Gould & Ratner in Chicago.

Pete is the co-chair of the Business Divorce Subcommittee of the Business and Corporation Litigation Committee of the Business Law Section of the ABA. He has extensive experience in the growing area of the business divorce, particularly requests for judicial dissolution of limited liability companies and corporations.

Bayard Sponsors First UnLocke the Light Event

Wilmington, Delaware- On Friday, February 8, 2019, Bayard’s Family Law Group sponsored and attended the SL24 Memorial Basketball Classic- UnLocke the Light at the newly opened 76ers Fieldhouse in Wilmington, Delaware. The event, hosted by BPG|SPORTS, drew a packed house for games between Ursuline, Saint Marks and Salesianum’s boys and girls junior varsity and Varsity teams. All proceeds from the event benefited the SL24 Foundation which was created in memory of Sean Locke, a stand-out basketball player at Saint Mark’s High School who went on to play at the University of Delaware, before losing his battle with depression in the summer of 2018. “Bayard was proud to be a sponsor of this special event remembering Sean Locke and supporting a vision of mental wellness,” said Curtis Bounds, head of the Family Law Group at Bayard. “We hope to participate in this important event for years to come.” In the marquee game of the evening, Saint Mark’s beat its rival, Salesianum 47-38. The last time the team beat Sallies in boys basketball was in 2010, when Sean Locke was a senior.

The primary focus of the of the foundation is to bring awareness to mental health. SL24 Foundation’s goal is to build and operate “Sean’s House” which will serve as a safe haven for high school and college students to go and receive professional help and speak to peers about their struggles with depression and the threat of suicide.

Scott Cousins to Speak at Emory Bankruptcy Developments Journal Symposium

Wilmington, Delaware- Bayard Director and co-chair of the firm’s bankruptcy group, Scott D. Cousins is scheduled to speak on a panel at the 16th annual Emory Bankruptcy Developments Symposium at Emory University School of Law in Atlanta, GA on February 21, 2019. Scott is speaking on the Corporate Bankruptcy panel titled Chapter 15 Choice of Law: A Formula for Conveyance Actions in a Shrinking World. The panel will focus on choice of law issues in chapter 15 and address other issues in cross-border insolvency.

Scott D. Cousins has more than 25 years of experience in the restructuring field. He has participated in many of the largest and most complicated business reorganizations, liquidations and distressed sales and acquisitions in Delaware’s state and federal courts. Wilmington, Delaware- On January 28, 2019, Bayard welcomed Jason C. Jowers as a Director in its Litigation Group. Jason concentrates his practice on corporate, alternative entity, and commercial litigation. He primarily represents members and managers of LLCs, officers and directors of corporations, and companies in high-stakes litigation in the Delaware Court of Chancery, Delaware Superior Court, Delaware Supreme Court, and United States District Court for the District of Delaware. Additionally, Jason handles arbitrations governed by the AAA Commercial Arbitration Rules, including cases governed by the Procedures for Large, Complex Commercial Disputes. Together, they bring years of experience to their new roles. They look forward to leading the group and building on the legacy that Bayard has established over the last 60 years.

In addition to his restructuring expertise during his years in private practice, Scott has wide-ranging experience in commercial transactions as a result of his role as in-house counsel for two large energy-related companies. From 2005 to early 2009, Scott served as General Counsel of NextEra Energy Resources LLC, a clean energy leader and one of the largest competitive energy suppliers in North America. He is a published author and a frequent speaker on issues and developments in bankruptcy and insolvency law.

Justin has participated in many large and complex commercial restructurings, with an emphasis on the representation of debtors, official committees of unsecured creditors and other key parties. In particular, Justin has significant experience negotiating and litigating issues involving valuation, structured finance, section 363 asset sales and contested confirmations in an array of industries including retail, healthcare, manufacturing, hospitality, energy and banking. Erin Fay Speaks at the 2018 ABI Winter Leadership Conference

Wilmington, DE- Erin Fay, a director in Bayard’s Business Restructuring and Liquidations group, served as a panelist at the American Bankruptcy Institute (ABI) Winter Leadership Conference entitled “The LLC’s Path Through Bankruptcy.” Erin was joined by experienced practitioners from firms across the U.S. to discuss the unique issues related to LLCs and bankruptcy law.
The conference took place from December 6-8th in Scottsdale, Arizona.

She is admitted to the State of Delaware bar and will be admitted to the United States District Court for the District of Delaware in a ceremony later this month.

Before joining Bayard, Sophie graduated from the Emory University School of Law. While in law school, Sophie served as the Executive Managing Editor of the Emory Bankruptcy Developments Journal. In recognition of her work as a staff member for the Journal, Sophie received the Michael P. Gullet Award for Excellence in Legal Writing and Editing in 2016.

Prior to law school, Sophie graduated magna cum laude from the University of Delaware with a B.A. in Political Science and History.

For the 15th consecutive year, Curtis Bounds, a Director and head of the firm’s Family Law Practice, presented summaries and trends from unreported opinions issued by the Family Court during the past year. Alongside Dr. Mandel Much and Cathy Seeber from CapTrust, Director, Kara Swasey spoke on Advising a Client with Substance Abuse Issues. Megan McGovern, an associate at the firm, served as a speaker on a panel discussion with the Honorable Robert Coonin and a University of Delaware Financial Aid Officer, that discussed the division of student loans in ancillary proceedings.

Marla Norton Wins ABA Cartoon Caption Contest

The American Bar Association just announced that Bayard, P.A.’s Marla H. Norton is the winner of the October Cartoon Caption Contest. The caption will appear in an upcoming issue of the ABA Journal. Contest participants were asked to consider what’s happening in the cartoon and submit clever, original captions. After the entries were reviewed by the ABA Journal staff, they pick their favorites and the readers then vote to select the best.

Evan Miller Speaks at Delaware TMA Event

Bayard attorney and TMA Philadelphia/Wilmington NextGen Chairman, Evan T. Miller, served as a panelist at the 6th Annual Delaware CLE and Cocktails program sponsored by the TMA Philadelphia/Wilmington Chapter on Thursday, October 18, 2018. The program took place at the Hotel DuPont in Wilmington, Delaware where panelists discussed third-party releases in Chapter 11 and recent jurisprudence as they pertain to debtors, creditors and asset purchasers. Kara Swasey Participates in Governor’s Roundtable

On October 9, 2018, Kara Swasey, a director in Bayard’s family law group, participated in a round table discussion at the Delaware Public Archives lead by Chief Judge Michael Newell of the Delaware Family Court about the Family Court Enhancement Project (“FCEP”). FCEP was a grant-based project that sought to study and improve outcomes for litigants in the Delaware Family Court facing disputes related to custody and domestic violence. Participants in the discussion included Governor John Carney, Supreme Court Justice Collin J. Sietz, the Honorable Arlene Minus Coppadge, the Honorable LuAnn Vari, the Honorable Jennifer B. Ranji, the Honorable Janelle Ostroski, the Honorable Andrew Southmayd, and a number of community stakeholders and domestic violence advocates within and outside of the Family Court who have worked on the project. Ms. Swasey served as a member of the FCEP management team and worked on a number of subcommittees within the project.
