Bayard Sponsors First UnLocke the Light Event

Wilmington, Delaware- On Friday, February 8, 2019, Bayard’s Family Law Group sponsored and attended the SL24 Memorial Basketball Classic- UnLocke the Light at the newly opened 76ers Fieldhouse in Wilmington, Delaware. The event, hosted by BPG|SPORTS, drew a packed house for games between Ursuline, Saint Marks and Salesianum’s boys and girls junior varsity and Varsity teams. All proceeds from the event benefited the SL24 Foundation which was created in memory of Sean Locke, a stand-out basketball player at Saint Mark’s High School who went on to play at the University of Delaware, before losing his battle with depression in the summer of 2018. “Bayard was proud to be a sponsor of this special event remembering Sean Locke and supporting a vision of mental wellness,” said Curtis Bounds, head of the Family Law Group at Bayard. “We hope to participate in this important event for years to come.” In the marquee game of the evening, Saint Mark’s beat its rival, Salesianum 47-38. The last time the team beat Sallies in boys basketball was in 2010, when Sean Locke was a senior.

The primary focus of the of the foundation is to bring awareness to mental health. SL24 Foundation’s goal is to build and operate “Sean’s House” which will serve as a safe haven for high school and college students to go and receive professional help and speak to peers about their struggles with depression and the threat of suicide.

Scott Cousins to Speak at Emory Bankruptcy Developments Journal Symposium

Wilmington, Delaware- Bayard Director and co-chair of the firm’s bankruptcy group, Scott D. Cousins is scheduled to speak on a panel at the 16th annual Emory Bankruptcy Developments Symposium at Emory University School of Law in Atlanta, GA on February 21, 2019. Scott is speaking on the Corporate Bankruptcy panel titled Chapter 15 Choice of Law: A Formula for Conveyance Actions in a Shrinking World. The panel will focus on choice of law issues in chapter 15 and address other issues in cross-border insolvency.

Scott D. Cousins has more than 25 years of experience in the restructuring field. He has participated in many of the largest and most complicated business reorganizations, liquidations and distressed sales and acquisitions in Delaware’s state and federal courts. He is also experienced in out of court restructurings and workouts. He has appeared in many bankruptcy jurisdictions across the country.

Wilmington, Delaware- On January 28, 2019, Bayard welcomed Jason C. Jowers as a Director in its Litigation Group. Jason concentrates his practice on corporate, alternative entity, and commercial litigation. He primarily represents members and managers of LLCs, officers and directors of corporations, and companies in high-stakes litigation in the Delaware Court of Chancery, Delaware Superior Court, Delaware Supreme Court, and United States District Court for the District of Delaware. Additionally, Jason handles arbitrations governed by the AAA Commercial Arbitration Rules, including cases governed by the Procedures for Large, Complex Commercial Disputes. Bayard Names Scott Cousins and Justin Alberto Co-Chairs of Bankruptcy Group

Scott has more than 25 years of experience in the restructuring field. Erin Fay Speaks at the 2018 ABI Winter Leadership Conference

Wilmington, DE- Erin Fay, a director in Bayard’s Business Restructuring and Liquidations group, served as a panelist at the American Bankruptcy Institute (ABI) Winter Leadership Conference entitled “The LLC’s Path Through Bankruptcy.” Erin was joined by experienced practitioners from firms across the U.S. to discuss the unique issues related to LLCs and bankruptcy law.
The conference took place from December 6-8th in Scottsdale, Arizona.

She is admitted to the State of Delaware bar and will be admitted to the United States District Court for the District of Delaware in a ceremony later this month.

Before joining Bayard, Sophie graduated from the Emory University School of Law. While in law school, Sophie served as the Executive Managing Editor of the Emory Bankruptcy Developments Journal. In recognition of her work as a staff member for the Journal, Sophie received the Michael P. Gullet Award for Excellence in Legal Writing and Editing in 2016.

Prior to law school, Sophie graduated magna cum laude from the University of Delaware with a B.A. in Political Science and History.

For the 15th consecutive year, Curtis Bounds, a Director and head of the firm’s Family Law Practice, presented summaries and trends from unreported opinions issued by the Family Court during the past year. Alongside Dr. Mandel Much and Cathy Seeber from CapTrust, Director, Kara Swasey spoke on Advising a Client with Substance Abuse Issues. Megan McGovern, an associate at the firm, served as a speaker on a panel discussion with the Honorable Robert Coonin and a University of Delaware Financial Aid Officer, that discussed the division of student loans in ancillary proceedings.

Marla Norton Wins ABA Cartoon Caption Contest

The American Bar Association just announced that Bayard, P.A.’s Marla H. Norton is the winner of the October Cartoon Caption Contest. The caption will appear in an upcoming issue of the ABA Journal. Contest participants were asked to consider what’s happening in the cartoon and submit clever, original captions. After the entries were reviewed by the ABA Journal staff, they pick their favorites and the readers then vote to select the best.

Kara Swasey Participates in Governor’s Roundtable

On October 9, 2018, Kara Swasey, a director in Bayard’s family law group, participated in a round table discussion at the Delaware Public Archives lead by Chief Judge Michael Newell of the Delaware Family Court about the Family Court Enhancement Project (“FCEP”). FCEP was a grant-based project that sought to study and improve outcomes for litigants in the Delaware Family Court facing disputes related to custody and domestic violence. Participants in the discussion included Governor John Carney, Supreme Court Justice Collin J. Sietz, the Honorable Arlene Minus Coppadge, the Honorable LuAnn Vari, the Honorable Jennifer B. Ranji, the Honorable Janelle Ostroski, the Honorable Andrew Southmayd, and a number of community stakeholders and domestic violence advocates within and outside of the Family Court who have worked on the project. Ms. Swasey served as a member of the FCEP management team and worked on a number of subcommittees within the project.

Pete Ladig Moderates Panel at 2018 ABA Business Law Section Annual Meeting

Wilmington, DE- Peter B. Ladig, a Director and Co-Chair of the Bayard, P.A. Business Litigation group, moderated a panel titled Business Divorce in Delaware, New York and California: Around the Horn, attended by more than 60 people at the ABA Business Law Section Annual Meeting in Austin, Texas.  Vice Chancellor Slights of the Delaware Court of Chancery, Justice Timothy Driscoll of the New York Supreme Court, Commercial Division, and Gail Andler, a recently retired judge from Orange County Superior Court in California appeared on the panel, along with lawyers from each state.  The panelists discussed what makes business divorce cases unique, the statutory bases for dissolution of an entity, the role of equity in business divorce, how to settle business divorce cases and shared lessons from the “big cases” in which they have participated.

The annual meeting took place from September 13-15th and was attended by over 1,600 business law professionals.

Pete has extensive experience in the growing area of the “business divorce,” particularly requests for judicial dissolution of limited liability companies and corporations. In addition to representing parties to a business divorce, Pete has served as counsel to a Chancery Court appointed custodian charged with selling an operating company to resolve a business divorce. He co-chairs the Business Divorce Subcommittee of the Business and Corporation Litigation Committee of the Business Law Section of the ABA; has spoken on other panels about business divorce; and has made substantial contributions to Litigating the Business Divorce, a publication from BNA.

The News Journal Names Bayard a Winner of the Delaware 2018 Top Workplaces Award

Bayard Selected as Delaware Counsel to the Brookstone Unsecured Creditors Committee

Bayard, P.A. has been selected to serve as Delaware counsel to the Official Committee of Unsecured Creditors (the “Committee”) in In re Brookstone Holdings Corp. (Case No. 18-11780 (BLS)). The Office of the United States Trustee formed the Committee on August 14, 2018. After its formation, the Committee selected Bayard, P.A. as its Delaware counsel, Cooley LLP as its lead counsel, and Province, Inc. as its financial advisor. Bayard attorneys Justin R. Alberto and Erin R. Fay are involved in the matter.

Brookstone Holdings Corp. (the “Debtors”) is a product developer and retailer of wellness, entertainment and travel products, headquartered in Merrimack, N.H.  The company announced its plans to close the remaining 101 mall retail locations in the immediate future. However, they will continue to operate their airport locations and continue operating its e-commerce website at http://www.brookstone.com/. The company filed for chapter 11 protection on Thursday, August 2, 2018, in the United States Bankruptcy Court for the District of Delaware.

Bayard Participates in Annual Delaware Minority Job Fair

On August 4, 2018, Bayard, P.A. participated in the 2018 Delaware Minority Job Fair (DMJF) as an interviewing employer. GianClaudio Finizio, Chair of the Hiring Committee and Erin R. Fay, both of Bayard’s Business Restructuring and Liquidations group, were responsible for coordinating the firm’s participation in the all-day event.

The Delaware Minority Job Fair (DMJF) is an invitation-only job fair geared towards second and third- year law students designed to promote diversity in hiring attorneys at Delaware law firms. The event attracts minority students from all over the country hoping to get a chance to practice law here in Delaware. The event included a breakfast, guest speaker and a half day of interviews with candidates.

Bayard, PA is pleased to announce that David Miller-Myers has joined the firm as an eDiscovery Coordinator as of July 23, 2018. David will coordinate and manage the electronic discovery needs of the firm’s clients in its litigation and bankruptcy practices. “Adding a dedicated eDiscovery professional like David allows Bayard to offer first-class eDiscovery management services to our clients and co-counsel.  In contrast to other Delaware firms without these capabilities, David will facilitate our litigation and bankruptcy groups in providing eDiscovery advice that ensures a defensible process under Delaware’s exacting standards,” says Pete Ladig, Co-Chair of Bayard’s litigation group.

David is a graduate of Villanova University School of Law in 2003 where he was a Dean’s Merit Scholar, participated on the Honor Board and was the Associate Editor of the Villanova Sports and Entertainment Journal.  He is admitted to practice law in Pennsylvania and New Jersey and has worked in a number of roles which include assisting in data review and trial preparation.  Prior to joining Bayard, David managed eDiscovery at a large firm in Philadelphia.
