Intellectual Property

Bayard is engaged in a diverse practice in the field of intellectual property law which draws on the broad capabilities of a number of attorneys in the firm. 

The firm's intellectual property litigation practice focuses on serving as Delaware counsel to firms involved in legally and technically complex patent litigation pending in the District of Delaware.  The District of Delaware is one of the busiest venues for patent litigation in the United States, and our attorneys have participated in bench trials and jury trials with each of the Court's judges, as well as many mediations and other pretrial proceedings with the Court's two Magistrate Judges.  Our attorneys and staff are familiar with the role of Delaware counsel and have the flexibility to meet the constantly changing demands.

The firm's intellectual property transactional practice involves advising clients regarding a variety of issues related to intellectual property protection, including counseling about the selection, protection and enforcement of trademarks and securing trademark protection.  We provide advice on trademark, copyright and domain name matters, and we assist our clients in preparing and prosecuting state and federal trademark applications and other documents necessary to maintain trademark registrations.  While we do not prosecute patent applications in the U.S. Patent and Trademark Office, we have established relationships with excellent firms that have that capability.  We also have experience drafting software and trademark licenses.
