United States District Court for the District of Delaware Amends Filing and Service Deadlines *UPDATED 10/16/2014*

Effective October 16, 2014, all electronic documents (including, but not limited to, motions, briefs, and discovery responses) must be filed and served by 6:00 p.m. Eastern Time in order to be considered timely.  The new filing deadline does not, however, apply to initial pleadings.  The Court’s October 2, 2014 Standing Order is available for download here.

*UPDATED* On October 15, 2014, Chief Judge Stark issued An open letter to counsel who practice in the District of Delaware to clarify the 6:00 p.m. eastern filing deadline.  Of particular note, the Court highlighted that the 6:00 p.m. EST deadline applies to “every filing and service deadline in every case in the District of Delaware,” and that parties will “not be able to alter the new deadline on a case-by-case basis.”  A copy of Chief Judge Stark’s letter is available for download here.
