Justin R. Alberto, a senior associate practicing corporate restructuring and litigation at Bayard, P.A., authored an article that was published in the July/August issue of The Federal Lawyer regarding the payment of committee members’ professional fees through a chapter 11 plan. The issue arose in the Lehman Bros. Holdings bankruptcy cases and the decision was rendered by the United States District Court for the Southern District of New York. The article discusses the District Court’s decision, reversing the Bankruptcy Court, by limiting in a plan context the reimbursement of professional fees incurred by members of an official committee and the lessons to be learned from the decision.
